Q1. What is NOPEC?
A1. The public energy buying group represents a large aggregation of member communities in Northeast Ohio named the Northeast Ohio Public Energy Council (NOPEC). NOPEC is a regional council of governments established in November, 2000 accordance with Ohio law. Under Ohio law, local governments may band together into an aggregation, or buying group. Voters in the 126 NOPEC member communities authorized electricity aggregation in elections starting in November, 2000. NOPEC, a non-profit organization, represents about 500,000 residential and small business electric customers in Ashtabula, Cuyahoga, Geauga, Lake, Lorain, Medina, Portage, Summit and Trumbull Counties. NOPEC is the largest such public energy aggregation in the United States. No taxpayer dollars are used to fund NOPEC operations.

Q2. How does NOPEC benefit me?
A2. With energy deregulation consumers are free to choose their energy provider. NOPEC was formed to help member communities benefit from deregulation. By participating in the NOPEC program, customers will receive discounted rates as compared to First Energy’s (Ohio Edison Company’s or Cleveland Electric Illuminating Company’s) standard service offer (SSO) generation charges.

Q3. Who is eligible for the lower NOPEC electric rates?
A3. If you live in a NOPEC electricity member community served by Ohio Edison Company or Cleveland Electric Illuminating Company and meet aggregation requirements, you are eligible for the NOPEC rate. The Program covers all eligible residential customer accounts and all eligible small commercial customer accounts located in the Utilities’ service territories. The Program will not include those customers enrolled in the percentage of income payment plan, customers on the PUCO’s “do not aggregate” list, customers who properly opt-out of the Program, customers under contract with another competitive retail electric service provider, mercantile customers that have not provided affirmative consent to join NOPEC’s aggregation, customers that have a special arrangement with the Utility, residential customers (rate code RS) eligible for the residential nonstandard credit provision under rider EDR, small commercial customers (rate code GS) that are eligible for the School Credit Provision under rider EDR, and such other customers not eligible for service under the Program, as determined by PUCO or Utility rules.

Q4. I don’t live in an area served by Ohio Edison or Cleveland Electric Illuminating Company, how can I get the NOPEC rate?
A4. The NOPEC program is only available in the following nine northeast Ohio counties: Ashtabula, Cuyahoga, Geauga, Lake, Lorain, Medina, Portage, Summit, and Trumbull. See the list of NOPEC electricity member communities served by Gexa Energy Ohio (below). If you do not live in one of these counties or communities, you are not eligible to get the NOPEC rate.

Q5. What are the NOPEC rates?
A5. For eligible residential customers (rate code RS), $0.0651 per kWh for electricity usage in July and August 2009, $0.0559 per kWh for September 2009 – December 2009, $0.0584 per kWh for January 2010 – May 2010, $0.0680 per kWh for June 2010, $0.0724 per kWh – for July and August 2010 and $0.0621 per kWh for September 2010 – your January 2011 meter reading date.

This base price is presently estimated to be about 12% lower in July through December 2009, 8% lower in the first six months of 2010 and 2% lower from July 2010 through your January 2011 meter reading date than the utility’s Price to Compare.

Your Price to Compare consists of bypassable generation and transmission related components, which are the charges associated with your utility’s costs for purchased power and to deliver the power through the transmission system. This base price may be adjusted up or down only to reflect changes in transmission rates or ancillary charges.

Note: The base price includes an uncollectible costs adder of $0.000539/kWh and does not include your utility’s charges, including any Commission-approved deferral surcharge, utility fees or riders and taxes. These percentage discounts may vary over these periods because the Price to Compare may change over these periods based on any changes made by your utility to its calculations. Actual savings during June, July or August will be lower for customers whose monthly usage during any of those months is below 950 kWh.

For eligible small commercial customers (rate code GS), $0.0673 per kWh for electricity usage in July and August 2009, $0.0578 per kWh for September 2009 - December 2009, $0.0600 per kWh for January 2010 – May 2010, $0.0699 per kWh for June 2010, $0.0732 per kWh for July and August 2010 and $0.0628 per kWh for September 2010 – your January 2011 meter reading date.

This base price is about 9% lower in July through December 2009 and 5.5% lower in the first six months of 2010 and 1% lower from July 2010 through your January 2011 meter reading date than the sum of the standard service offer generation service price (Rider GEN) and the non-distribution uncollectible amount (Rider NDU) currently charged by your electric utility. This base price may be adjusted up or down only to reflect changes in transmission rates or ancillary charges.

Note: This base price includes an uncollectible costs adder of $0.000539/kWh and does not include your utility’s charges, including any Commission-approved deferral surcharge, utility fees or riders and taxes.

Q6. When will the NOPEC rate be effective?
A6. Depending on your initial meter reading date, the NOPEC rate can take effect on the customers’ August 2009 or September 2009 meter read date and will be in effect until the customers’ January 2011 meter read date.

Q7. How will I know if I can save money with NOPEC?
A7. Under the NOPEC program, the price you pay for electric generation supply is guaranteed to be lower. You may refer to your utility bill under “Price to Compare Message”.

Q8. If I join NOPEC program, who will deliver my power, read my meter and respond to emergencies, such as power outages once I am a Gexa Energy Ohio customer?
A8. The utility that serves your community, Ohio Edison Company or Cleveland Electric Illuminating Company, will be responsible for the delivery of power to your home or business. Since your local electric utility still owns the wires and poles that deliver power to you, they will continue to perform maintenance and repairs, read your meter and restore power after an outage. You should continue to call your local electric utility if your power goes out. To report an outage, call 1-888-544-4877. The Public Utilities Commission of Ohio will still oversee the safety and reliability of your service.

Q9. When will the NOPEC offer be sent in the mail?
A9. Eligible member participants will be sent detailed information in July 2009.

Q10. Am I required to accept the NOPEC program?
A10. No. When you receive information outlining the details of the program, you have the option at that time to opt out of the program without charge by returning the opt-out response within 21 days after the mailing date on the notice.

Q11. What does “opt out” mean?
A11. Opt out means that you can decide not to participate in the NOPEC program. By returning the opt- out form, which is included in the written materials mailed to you, you will not be enrolled in the NOPEC program and you will not receive the discount.

Q12. If I opt out of the NOPEC program, who will be my electricity provider?
A12. Your utility company, Ohio Edison Company or Cleveland Electric Illuminating Company, will continue to be your electricity provider.

Q13. What happens if I do not send in the opt-out form?
A13. If you do not return the opt-out form within 21 days after the mailing date on the notice, you will be included in the NOPEC program and will begin receiving competitively priced electricity from Gexa Energy Ohio.

Q14. Can I switch back to my utility or another Supplier at a later date?
A14. Yes. The Exit Fee is $25 for residential customers and $300 for commercial customers. NOPEC’s price is in effect until the January 2011 meter read date. You will not be charged the Exit Fee if, 1) you leave the program because the agreement between NOPEC and Gexa Energy Ohio is terminated, 2) you move from your service location or 3) you enroll in the Utility’s percentage of income payment program.

Q15. What is the toll-free number in case I have questions?
A15. For answers about your NOPEC electricity rates or terms and conditions, please call 1-888-223-9292, Monday through Friday, 8am – 7pm ET.

Q16. Will I receive one bill or two?
A16. For your convenience, you will continue to receive one bill from your current utility, Ohio Edison Company or Cleveland Electric Company.

Q17. Who do I call if I have a question on my bill or a question about my usage?
A17. The utility that serves your community, Ohio Edison Company or Cleveland Electric Illuminating Company, will assist you with questions about your bill or usage just as they do today. For Ohio Edison Company, call 1-800-633-4766 or Cleveland Electric Illuminating Company, call 1-800-589-3101.

Q18. Can I keep my budget billing?
A18. Budget billing is not currently offered for the Supplier portion of your bill, however, it may be offered in the future. The utility portion of your bill may remain on budget billing.

Q19. Who do I call to start or disconnect service?
A19. The utility that serves your community can assist you. Call Ohio Edison Company at 1-800-633-4766 or Cleveland Electric Illuminating Company at 1-800-589-3101 to assist you with initiating new service or disconnecting service, just as they do today.

Q20. Are there any other services you offer as part of the electricity deal?
A20. Gexa Energy is committed to providing superior customer service and the same reliable power that you’re accustomed to; you simply pay less for it. Since our primary goal is to be your electricity Supplier of choice, no other services are offered in connection with the NOPEC Electricity Aggregation Program.
